1. Scope
In case
of doubt or antinomy concerning the German or the English or the Latin
version of these AGB, the German version will be decisive.
Between the publisher LEO LATINUS and the orderer are in force
exclusively the existing General Business Conditions (AGB) in the
version that is valid at the time of the order. We do not recognize
conditions adverse or differing from our AGB.
2. Prices
Our
prices are effective ex publishing place. The costs for dispatch and
package are paid by the orderer. The costs for dispatch are assessed,
if the article is ordered; they are specified in this AGB under point 5.
3. Conclusion of contract
Your contract with us is achieved, if we accept your order by sending
the article.
4. Conditions of payment and delivery
The
payment is effected against invoice within 10 days from the date of
invoice. The purchase price falls due and is payable immediately. You
can pay by transfer, COD or by Pay Pal.
Sending per COD is possible only within Germany. The additional costs
for COD item are paid by the orderer.
At the moment, the costs for COD amount to € 7,50.
If it comes to default in payment, we are entitled to charge you
default interest 5% over the basic interest rate which is valid at the
time in question. It remains unaffected to plead a damage caused by
delay exceeding that. As far as you pay per direct debit or debit
advice, we set off the payment after sale of goods.
Obligatory terms of delivery must be arranged in writing. The arranged
delivery period begins with the date of the acknowledgment of order.
The delivery period is observed i the article is sent before expiry.
Usually the delivery is effected within four workdays after receipt of
order.
We reserve ourselves the ownership of the delivered article until
complete payment. We must reserve ourselves in special cases to deliver
only against prepayment.
5. Costs of dispatch and package
For deliveries within Germany the following prices are effective:
4,00 € until 4 CDs incl.
6,00 € more than 4 CDs
7,50 € in addition for COD
For deliveries within Europe are effective:
6,00 € until 4 CDs
8,00 € more than 4 CDs
For deliveries into the rest of the world:
10,00 € until 4 CDs incl.
15,00 € more than 4 CDs
6. Right of countermand
You are
not more bound by your order, if you countermand it within a period of
two weeks after having received the article. If you countermand, you
need no special explanation, but you must declare it in writing (e.g.
by a letter, by fax) or by resending the article within two weeks. For
observing the period its enough to send timely the countermand or the
article. The right of countermand lapses, if the sealed package of
delivered CD-ROM has been open.
In the case of countermand you are obliged to resend the article
immediately in a suitable package at the expense and risk of LEO
LATINUS.
The sales contract after resending the article is cancelled. Payments
already made you get reimbursed. If you make use of your right of
countermand, you have to carry the costs of resending.
7. Guarantee
The guarantee begins with the delivery of the article.
The period of prescription for legal claims of defects amounts to two
years.
8. Place of
performance ande place of jurisdiction
Place
of performance is Weißenhorn. Place of jurisdiction for all
litigations is Neu-Ulm, provided that the orderer is a qualified
merchant, juridical person of public law or separate estate under
public law or has not a general place of jurisdiction at home.
In the business with final consumers also the court of the final
consumer's domicile is responsible. Besides of that the right is usable
at the domicile of the final consumer, provided that necessarily it
concerns requirements of consumer rights.
